They were in no danger and the driver wisely waited until the gate was up all the way.  Contributor's Pick!       
As you can see, the crossing is at about a 45 degree angle, so the gates are out from the rail a ways. Additionally, the train comes out of an underpass just to my right, so he would have to pull up in order to see down the track. This bus driver did nothing wrong here.
